General Terms and Conditions Free Wheely
This is the fine print. We believe it’s important to share this with you, so please read it carefully. We have tried to use as little legal jargon as possible, but sometimes it is necessary.

Article 1 – General
1.1 This webshop is part of Free Wheely. All orders are subject to the terms and conditions set by Free Wheely.
1.2 By placing an order, you agree to these terms. Free Wheely reserves the right to amend these terms at any time.
1.3 Free Wheely is registered with the Dutch Chamber of Commerce under number 88490939.
1.4 Dutch law applies to these terms and conditions.
1.5 Any disputes between parties will be submitted to the competent court in the Netherlands.
Article 2 – Agreement
2.1 Free Wheely reserves the right to change prices and texts. Offers and product descriptions are therefore non-binding.
2.2 An agreement is only concluded after written order confirmation by Free Wheely. We reserve the right to refuse orders or impose additional conditions.
Article 3 – Information
3.1 The information on our website and in other communications has been compiled with care. However, we cannot guarantee the completeness or accuracy of this information and accept no liability for any errors.
3.2 Free Wheely is not responsible for the content of external websites referred to via hyperlinks.
3.3 We are not liable for misunderstandings, delays, or failures in communication via the Internet or other means, unless there is intent or gross negligence on the part of Free Wheely.
Article 4 – Prices and Payments
4.1 All prices are in euros, including VAT, but excluding any shipping costs and other charges unless otherwise stated.
4.2 Payment must be made in advance or upon delivery, unless agreed otherwise in writing.
4.3 All offers are non-binding. We reserve the right to adjust prices, for example due to statutory provisions. Orders already placed will be executed at the old price.
4.4 Free Wheely is not bound by prices that are clearly incorrect, for example due to a typo or system error.
Article 5 – Quotations
5.1 Quotations are non-binding unless stated otherwise.
5.2 Upon acceptance of a non-binding quotation, Free Wheely reserves the right to withdraw or amend it within three (3) working days of acceptance.
5.3 Verbal promises are only binding after written confirmation by Free Wheely.
Article 6 – Delivery
6.1 Delivery is subject to availability.
6.2 If you choose shipping, the products will be delivered to the address you provide.
6.3 You can also pick up your order at a location designated by Free Wheely.
6.4 Shipping costs are calculated according to the current rates on the website.
6.5 The delivery time is a maximum of 30 days, unless otherwise agreed. If this term is exceeded, you can cancel the agreement and will receive a refund within 14 days.
6.6 Delivery times are indicative and not binding.
6.7 If a product is delivered incorrectly or defective, you can exchange it free of charge.
Article 7 – Retention of Title
7.1 All delivered products remain the property of Free Wheely until full payment has been made.
7.2 If you have not paid in full, you may not sell, pledge, or otherwise encumber the products.
7.3 In the event of non-payment, Free Wheely has the right to reclaim the products without prior notice of default.
Article 8 – Warranty and Complaints
8.1 The warranty conditions are the same as those of the product’s manufacturer. A valid proof of purchase is required for any warranty claim.
8.2 Warranty claims are assessed and handled by the manufacturer or supplier.
8.3 Wear-sensitive parts such as bearings, tires, and clothing are only covered by warranty if the defect is not caused by use.
8.4 Warranty lapses in case of:

negligent maintenance;
-
intentional or careless damage;
-
repairs or modifications by unauthorized mechanics.
8.5 Upon delivery, you must check whether the products comply with the agreement. Any complaints must be reported in writing within 7 working days of receipt.
Article 9 – Returns
9.1 You have the right to return a product within 14 days of delivery. Return shipping costs are at your expense.
9.2 Refunds will be made once we have received the product in its original condition and packaging.
9.3 Returns will be refused if the product is used, damaged, or not in its original packaging.
9.4 Once the return is approved, the purchase amount will be refunded within 30 days.
Article 10 – Personal Data
10.1 Free Wheely respects your privacy and processes personal data in accordance with the General Data Protection Regulation (GDPR).
10.2 Personal data will only be used to process orders, payments, and customer service. Your data will not be shared with third parties without your consent.
Article 11 – Force Majeure
11.1 Free Wheely is not liable for delays or shortcomings caused by force majeure.
11.2 Force majeure includes but is not limited to:

delivery problems with suppliers;

strikes or government measures;
-
transport or communication failures.
11.3 In the event of force majeure, Free Wheely may modify or dissolve the agreement without compensation.
Article 12 – Liability and Disclaimer
12.1 Free Wheely strives to keep all information on the website correct and up to date but cannot guarantee that it is error-free.
12.2 Free Wheely is not liable for damage resulting from errors, delays, or incomplete information.
12.3 We are not responsible for the content of external websites to which we refer.
12.4 Free Wheely is not liable for personal injury, damage to bicycles, clothing, or other personal property. Maximum liability is limited to the invoice amount of the delivered product.
12.5 Deviations from these terms do not entitle you to assume the same deviation in future cases.
Workshop Terms and Conditions Free Wheely
Article 1. General
1.1 These conditions apply to all maintenance and repair work carried out by Free Wheely.
1.2 By commissioning maintenance or repair, the customer agrees to these terms.
Article 2. Quotations and Cost Estimates
2.1 Free Wheely may provide a cost estimate in advance. If additional repairs are necessary during the work, this will first be discussed with the customer.
2.2 If the customer does not agree to the additional costs and the repair is not carried out, inspection costs may be charged.
Article 3. Repair Duration and Liability
3.1 The repair duration given by Free Wheely is indicative. Delays do not entitle the customer to compensation.
3.2 Free Wheely is not liable for damage resulting from normal wear and tear, misuse, or faulty previous repairs by third parties.
3.3 Damage resulting from improperly performed repairs by Free Wheely will be corrected at no extra cost to the customer.
Article 4. Retention of Title and Unpaid Repairs
4.1 All replaced parts and accessories remain the property of Free Wheely unless otherwise agreed.
4.2 A repaired bicycle will only be returned after full payment has been made.
4.3 If a customer does not collect the repaired bicycle within 3 months after the repair, Free Wheely has the right to sell the bicycle to cover the costs.
Article 5. Warranty on Repairs
5.1 Free Wheely offers a 3-month warranty on repairs performed. This warranty only covers the same defect and does not apply to normal wear and tear or new defects.
5.2 The warranty expires if the customer or a third party performs work on the bicycle after the repair.
Article 6. Payment and Invoicing
6.1 All payments must be made when collecting the bicycle unless otherwise agreed.
6.2 Free Wheely accepts cash payments, debit card, and online payments.
Article 7. Liability
7.1 Free Wheely is not liable for loss, theft, or damage to bicycles or accessories left in our workshop, unless there is intent or gross negligence.
